Student Voices Competition Rules

These Terms of Use are intended to accompany certain videotaped interviews and segments (“Interviews”), as provided to you (“You”) by the University of Southern California Shoah Foundation (“USC SF”), and your video project submission that incorporates portions of the Interviews (“Video”) in relation to this film contest (“Contest”). Your use of the Interviews in your Video and participation in the Contest is conditioned upon your acceptance of the following Terms of Use (“TOU”) between USC SF and You.

Please read these terms and conditions before using these Interviews. By participating in this Contest, you agree to the Terms of Use. These TOU govern your access to and use of USC SF Interviews and Your Participation in the Contest and You agree to be bound by these TOU.

Official Rules

  1. Eligibility

    This Contest is open to currently enrolled undergraduate and graduate students at the University of Southern California. Limit one entry per student or student group. Groups may consist of no more than three students. To be eligible to win a prize, entries must be completed and received by USC SF in the manner designated below. Immediate families of USC SF staff members are not eligible to win any prize. Entrants agree to be bound by these Official Rules and by the decisions of USC SF.

  2. Disclaimer; Release

    By participating in the Contest, you agree to release and hold harmless USC SF, its respective parent institution, and each of their respective directors, officers, professional advisors, employees, and agencies (together, the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) any late, lost, misrouted, garbled, distorted, or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; (d) any printing or typographical errors in any materials associated with the Contest; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by Your participation in the Contest or receipt or use of any prize. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

  3. Contest Period

    The Contest starts at 12:01 AM on November 1, 2013 and ends at 11:59 PM on January 17, 2014 (the “Contest Period”). All entries must be received during the Contest Period to be eligible to win a prize.

  4. How To Enter

    To enter, take the following steps during the Contest Period:

    • Register by November 1, 2013. Upon registering, you will be asked to RSVP for an Ethical Editing and Searching the archive workshop. Attendance to these workshops is highly recommended. The workshop dates can be found under the "Workshops" tab.

    • Using the Interviews from the USC SF archive, develop an original Video that addresses at least one of the yearly themes available on the Student Voices website.
    • The Video must incorporate footage from the USC SF Interviews.
    • The Video may, but is not required, to incorporate other video and/or audio materials; however, USC School of Cinematic Arts participants may not use their production numbers to access school-issued equipment nor can they access the Screen Actors Guild Agreement to produce a contest entry. Nor will they be covered by the school”s liability and property insurance, including Errors and Omissions insurance.
    • The Video must be no more than ten minutes in length to be eligible to win;
    • Visit sfi.usc.edu/teach_and_learn/student_opportunities/student_voices/rules for specific format and instructions and to complete the online entry form for the Contest;
    • Submit your finished Video both 1) on a video DVD and 2) via ftp as follows:
      • Deliver your DVD to the USC Shoah Foundation office at Leavey Library, 650 W. 35th Street, suite 114, Los Angeles, CA 90089 before 4:30 PM on January 18, 2014.
      • In addition, upload your video to this ftp site: ftp://vhi-ftp.usc.edu . To access, use an FTP client, such as Filezilla, or, if on a PC, use “my computer” and enter the ftp address in the address bar to log in.
        • Username: usc
        • Password: filmcontest
    • The Video file must be labeled with the project title and your first and last name.

    The Video may be in a language other than English, provided that English subtitles are included on the Video. An entry into the Contest consists of your completed online entry form and your Video (together, the “Entry Materials”). All requested information must be provided for your entry to be valid. By entering the Contest, you consent to being placed on an e-mail mailing list for promotional and other purposes.

  5. Judging Criteria

    Student Videos will be evaluated by a jury of USC faculty and special guests, using the following “Judging Criteria” in order to determine the finalists (“Finalists”) and the Contest winner(s) (“Winner(s)”). In addition, Videos may, at USC SFI’s discretion, also be posted online for peer voting in order to determine the Viewer’s Choice Award.

    Videos will be evaluated on the basis of the following Judging Criteria:

    • The most successful use of the Interview footage in order to demonstrate one of the Contest themes.
    • Displaying sensitivity to the Interview content and themes and how they are incorporated into the Video project.
    • Clarity of the message and narrative arc presented in the Video.
  6. The Prize

    Cash prizes up to $750 will be awarded to a limited number of contest winners. The prize is not transferable. No substitutions or exchanges of any prize will be permitted. The value of the prize may be reported for tax purposes as required by laws. Winners will be solely responsible for all applicable federal, state, and local taxes.

  7. USC SF Ownership Rights in Interviews

    USC SF owns the worldwide copyrights to the Interviews. Nothing in these TOU affects such copyright ownership. The information contained in the Interview(s) involves privacy interests and is not in the public domain.

  8. USC SF Rights to Entry Materials

    You hereby grant to USC SF and Our affiliates a perpetual, irrevocable, worldwide, royalty-free nonexclusive license to publish for any purpose the Entry Materials that You submit to the Contest. The USC SF can, without limitations, reproduce, display, perform, broadcast, distribute, adapt, edit, modify, translate, disclose, transmit, publicize, and create derivative works based upon the content You submit to this Contest. USC SF will have no obligation to publish or use or retain any Entry Materials you submit or to return any such Entry Materials to you.

    You grant the USC SF permission to use certain information about yourself in connection with your Video, including your name, image, and other profile information in connection with the Contest and USC SF for promotional purposes without further permission or compensation.

    USC SF reserves the right, in its sole discretion, immediately and without notice, to suspend or terminate these TOU and/or your ability to access the Contest, for any reason including any breach by you of these TOU or conduct by you that we determine inappropriate.

  9. Your Rights and Responsibilities

    You may download the USC SF Interviews from the URL provided for the sole purpose of participating in the Contest. You may not publicly exhibit, distribute, reproduce, copy, edit, or otherwise use the downloaded Interviews or Your Video outside of the context of participating in the Contest except with the prior written consent of USC SF.

    You are prohibited from incorporating into Your Video any unlawful, threatening, libelous, defamatory, inflammatory, or pornographic material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting any such information or materials.

    You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights of third party materials contained in your Video, including the right to post on the Internet for educational purposes. You will defend, indemnify and hold the Released Parties harmless from any claims and liabilities related to any third party claim that Your Video infringes or misappropriates any third-party intellectual property rights. You agree to cite the USC SF in your Video credits, in substantially the following form: “Interviews of [names of interviewees] are from the archive of the University of Southern California Shoah Foundation Institute for Visual History and Education. For more information, visit: www.usc.edu”; You agree that the USC SF Interview material used shall contain copyright notice, visible on the video during all segments of the Interviews, which reads © (1994 - year of creation) USC Shoah Foundation, and that is legible to end users.

    You also agree, as a condition Your participation in the Contest, to take, at USC SF’s expense, any further action (including, without limitation, execution of assignments, transfers, affidavits and other documents) reasonably requested by USC SF to effect, perfect, or confirm USC SF’s rights in and to your Video or other rights granted in this Agreement.

  10. Miscellaneous

    The Contest and these Official Rules will be governed, construed, and interpreted under the laws of the State of California. Entrants agree to be bound by these Official Rules and by the decisions of USC SF, which are final and binding in all respects. USC SF reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel, postpone, or extend the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention, or other causes beyond USC SF’s control affect the administration, security, or proper play of the Contest or USC SF otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, violate any law, rule, or regulation in connection with participation in the Contest, tamper with the operation of the Contest, or engage in any conduct that is detrimental or unfair to USC SF, the Contest, or any other entrant (in each case as determined in USC SF's sole discretion), are subject to disqualification from entry into the Contest.
